1. Who we are

Sweetpea Hospitality LLC ("SPH", "we", "us"), doing business as Sweet Pea Hospitality, is a California limited liability company operating short-term rental properties in San Jose, CA. These Terms govern your use of this website and any booking you make directly with us.

2. Bookings and payment

When you book through this site you are charged the total shown at a secure Stripe checkout, and your reservation is confirmed upon successful payment. We use Stripe Identity to verify the reservation holder's government ID before check-in details are released. A booking may be cancelled with a full refund if identity verification cannot be completed. We reserve the right to decline or cancel a booking that violates these Terms, with a full refund of any amounts paid.

3. Stays and house rules

Every confirmed stay is subject to our House rules and Cancellation policy, which are incorporated into these Terms. The reservation holder is responsible for all members of their party.

Guest responsibilities and damage

The reservation holder must be a staying guest and is responsible for the conduct of their party and for damage, missing items, or excess cleaning beyond normal wear, which may be charged with documentation. Registered guests only; visitors require prior approval. We or our vendors may enter the property with reasonable notice for maintenance, or immediately in an emergency. Guests use the property at their own risk and agree to hold SPH harmless except where caused by our gross negligence or willful misconduct.

4. Text messages

If you opt in, we may text you about your booking. Messages are operational and related to your stay only, never marketing. Reply STOP to opt out or HELP for help. Message and data rates may apply. See our Privacy policy for how we handle your information.

5. Acceptable use

Use of this site and our services is subject to applicable law. You may not use the site to submit false information, attempt unauthorized access, or interfere with its operation.

6. Disclaimer of warranties

This website and our services are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee that the site will be uninterrupted or error-free.

7. Limitation of liability

To the maximum extent permitted by law, SPH shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to this website or our services.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Santa Clara County, California.

9. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent change.
